Notice of Driver License Suspension

A Notice of Suspension may result from a failure on the part of the driver to answer or appear on a traffic ticket within thirty to sixty days after the return date of the ticket. A driver who receives a Notice of Driver License Suspension or Driving Privilege Suspension must answer or appear on the traffic ticket prior to the suspension date stated in the Notice in order to avoid a suspension of driving privileges. This involves a court appearance to have the traffic ticket placed on the court’s calendar in advance of the scheduled suspension date. If this occurs, the court clerk will notify DMV that the traffic ticket has been answered and the suspension will be avoided. If the traffic ticket remains unanswered, the suspension of driver’s license or driving privileges will go into effect at 12:01 a.m. on the suspension date. Unfortunately, many drivers facing suspension are not aware that a Notice of Suspension has been issued because NYSDMV does not have a current address for the driver and the Notice is sent to an old address and not forwarded. Out-of-state drivers who have had their driving privileges suspended in NY for a failure to answer a traffic ticket are now finding that their NY suspension must be cleared in order for them to renew their driver’s license in their home state.

Our Process

Paul Tuths takes a personal, hands-on approach to address a Notice of Suspension. He will interview you over the telephone and through emails and review your documentation to obtain as much information as possible regarding the circumstances surrounding your outstanding ticket and Notice of Suspension.  He will provide you with detailed information on how to respond to the Notice of Suspension.  Once retained, Paul Tuths  will contact the court to have the open traffic ticket placed on the court calendar as soon as possible and appear personally on your behalf to discuss a proposed reduction or dismissal with the prosecutor. We are able to proceed in court on most traffic tickets without your personal appearance based upon your written authorization in order to obtain a final disposition to your traffic ticket. We prepare the authorization letter for you to sign. From start to finish, Paul Tuths will be the attorney personally handling your traffic ticket and Notice of Suspension. We DO NOT farm out cases to other attorneys to make our court appearances.  We use our many years of experience in the courts of Suffolk County and eastern Long Island to get the best possible result for you. At the conclusion of the court case, Paul Tuths will contact you to advise you of the final disposition on the traffic ticket, the fine imposed by the court (unless the ticket has been dismissed) and the date by which payment of the fine is due.

Fees

We charge on a flat rate basis for our legal services on traffic law matters. The amount of the charge depends on the number and nature of the traffic violations which the driver has received. Our flat rate charge covers all services including review of the traffic charges and driving record, consultations and correspondence with the driver, court appeareances and final wrap-up with the driver. There is no charge for an initial consultation on traffic violations. Our fee does not include any fines and surcharges which may be imposed by a court. All fines and surcharges are the sole responsibility of the driver. Payment of fines must be received at the court by the due date. If payment is not received by the due date, driving privileges will be subject to suspension by the NYS Department of Motor Vehicles.

We do accept credit cards but clients usually pay our fee with a personal check.
